On Tuesday, the European Securities and Markets Authority (ESMA) published its final guidance to aid member states in implementing the upcoming rules. The guidance includes a final report on reverse solicitation, systems, and what constitutes a financial instrument in the context of cryptocurrency, as well as draft technical standards for preventing market abuse.

The European Union's Markets in Crypto Asset (MiCA) regulations, which are tailored to the crypto industry, are scheduled to take effect on December 30 across all 27 member states. However, some countries have yet to enact legislation to implement MiCA, with Portugal's central bank stating that it has not yet determined which national authority will be responsible for overseeing the rules due to pending legislation.

The short timeframe between ESMA's release of its final technical standards in October and the implementation deadline has contributed to delays for national authorities, according to industry trade associations. ESMA Chair Verena Ross stated, "As we move forward, we will continue to provide guidance and work with all National Competent Authorities to ensure a seamless implementation of MiCA and support a level playing field through supervisory convergence actions."
