Coinbase has submitted a petition to a US appeals court, seeking a ruling on whether crypto transactions on its platform are subject to federal securities laws. In a recent court filing, Coinbase's lawyers urged the Second Circuit Court of Appeals to hear the case, emphasizing its significance in providing clarity on the regulation of digital asset trading. The lawyers argued that the case is of immense importance to the crypto industry, consumers, and financial institutions, and that it presents an ideal opportunity for the court to establish clear guidelines for the multi-trillion-dollar industry. Coinbase contends that its platform's crypto transactions do not trigger federal securities laws, as they do not meet the requirements of the Howey test, a longstanding legal framework for determining investment contracts.

The petition follows a rare stay issued by the Southern District of New York, allowing Coinbase time to appeal to a higher court for clarity on the matter. The US Securities and Exchange Commission had sued Coinbase in June 2023, alleging that the exchange was operating as an unregistered securities exchange, broker, and clearing agency. The case has been put on hold while Coinbase seeks guidance from the Second Circuit.

Meanwhile, the SEC has announced the formation of a crypto task force, signaling a shift in its approach to regulating the industry.
