El Salvador's Comisión Nacional de Activos Digitales (CNAD), the primary agency responsible for overseeing digital assets in the country, is working to establish a collaborative regulatory framework with the US Securities and Exchange Commission (SEC). According to Juan Carlos Reyes, president of the CNAD, the goal is to foster international cooperation, emphasizing that digital assets transcend geographical boundaries and that regulatory collaboration should follow suit. El Salvador's unique position, having introduced bitcoin as legal tender in 2021 without pre-existing strong financial institutions or a developer ecosystem, allowed the CNAD to create a tailored regulatory framework for crypto from scratch. Nearly two years after Reyes took the helm, major crypto players such as Tether, Bitfinex, and Binance have set up operations in the country, drawn by its advanced regulatory environment.
The CNAD proposes that the US SEC utilize El Salvador as a real-world case study to assess streamlined approaches to digital asset regulation, essentially learning from El Salvador's experiences as the SEC revamps its own framework. A proposed pilot program involves scenarios such as a US-licensed traditional finance broker obtaining a digital asset license under CNAD regulations and the development of small-scale tokenization offerings, each capped at $10,000.
These initiatives align with objectives outlined by SEC Commissioner Hester Peirce, who indicated a shift in the SEC's approach to crypto regulation. The CNAD's advisory group member, Erica Perkin, noted that they closely examined Peirce's document to identify how they could assist, offering their framework as a means to collect data the SEC might find valuable.
A meeting between the CNAD and the SEC's Crypto Task Force on April 22 was constructive, with both parties engaged in open discussion. Reyes has already signed cooperation agreements with countries like Argentina and Paraguay, viewing the SEC as ahead of the curve in understanding digital asset regulatory needs.
He praised the quality and understanding of the SEC Crypto Task Force, finding the discussions refreshing and on point regarding the needs for regulating the technology.
