The crypto market structure bill aims to provide a clear framework for the industry, but its prospects are uncertain. The Securities and Exchange Commission has issued staff statements, but these are not permanent guidance, and the SEC needs time to develop rules that can be subject to a notice-and-comment period. Without the Clarity Act, the industry risks facing similar challenges in the future. Memorial Day, May 25, is seen as a critical deadline for legislation to advance if it is to have any chance of passing before the election. Before Congress breaks for the summer, it will need to address other pressing issues, including funding for the Department of Homeland Security and the potential appointment of Kevin Warsh as the next Fed chair. The crypto industry is eager to see the bill passed, with over 100 organizations signing an open letter urging a markup hearing in the Senate Banking Committee. However, the committee's progress on the bill remains unclear, and several outstanding issues need to be resolved before it can move forward. Even if these issues are addressed, the House will still need to vote on the bill again. Congressman French Hill, who chairs the House Financial Services Committee, believes that many of the outstanding issues have already been resolved by the House in its version of the bill, and that the Senate should be able to find common ground.
