Time's Running Out for Clarity on Crypto Legislation
The crypto market structure bill has seen minimal progress over the past month, making its passage increasingly uncertain. As the clock ticks down, the crypto community is left wondering if the legislation will ever come to fruition. The bill's fate is far from sealed, but one thing is clear: time is of the essence. The current state of market structure issues, such as SEC staff statements, is not permanent and can be changed by future administrations. The crypto industry is pushing for the Clarity Act to cement regulations into law, making it more difficult for future administrations to undo them. Memorial Day, May 25, is seen as a deadline for legislation to advance if it is to have a chance at passage before the election. Lawmakers will soon leave town to focus on their campaigns, leaving little time for the crypto bill. Before Congress departs, it will need to address funding for the Department of Homeland Security and the potential appointment of Kevin Warsh as the next Fed chair. The crypto industry is eagerly awaiting the bill's progress, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it remains unclear how close the committee is to moving forward, with outstanding issues such as stablecoin yield and decentralized finance still unresolved. Even if these issues are resolved, the House will need to vote again on the bill. Congressman French Hill believes that many of the outstanding issues have already been addressed by the House in its version of the bill, making it easier for the Senate to find common ground.
