Time's Running Out for Crypto Clarity

As April draws to a close, the crypto market structure bill has seen little public progress. While predicting the bill's fate is challenging, it's clear that time is of the essence for its passage. The bill's prognosis is uncertain, but the approaching deadline is likely to increase anxiety in the industry. The narrative surrounding the bill's potential passage this month is bleak, and the process is far from over. Much of the recent activity, such as SEC staff statements, is not permanent guidance, and the SEC needs time to establish rules through a notice-and-comment period. The market structure legislation aimed to solidify crypto industry goals and regulations into law, making it more difficult for future administrations to undo these rules. Without the Clarity Act, the industry may face similar conversations in the future. Memorial Day, just a month away, has been seen as a 'drop-dead' date for legislation to advance and have a chance at passage before the election. Before Congress leaves for their campaigns, they will focus on funding the Department of Homeland Security and the potential appointment of Kevin Warsh as the next Fed chair. The crypto industry is eagerly awaiting the bill's passage, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it's unclear how close the committee is to moving forward, and outstanding issues such as stablecoin yield and decentralized finance remain unresolved. Even when these issues are resolved, the House will need to vote again on the bill. Congressman French Hill believes that many of the outstanding issues have already been addressed by the House in its version of the bill, and the Senate should be able to find common ground.
