Time Runs Out for Clarity on Crypto Legislation

The proposed crypto market structure bill has seen little public progress over the past month. While predicting the bill's outcome is challenging, it's clear that time is running out for its passage. The crypto market has been awaiting clarity on regulatory issues, with the Securities and Exchange Commission staff statements offering non-permanent guidance. The crypto industry seeks to cement its goals and regulations into law, making it harder for future administrations to undo these rules. Without the Clarity Act, the industry may face similar conversations in the future. Memorial Day, May 25, is seen as a deadline for legislation to advance and have a chance at passage before the election. Lawmakers will soon focus on their campaigns, leaving little time for crypto legislation. Before Congress leaves, it must address funding for the Department of Homeland Security and the potential appointment of Kevin Warsh as the next Fed chair. The crypto industry is eager for the bill's passage, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it's unclear how close the committee is to moving forward, with outstanding issues such as stablecoin yield and decentralized finance still unresolved. Even when these issues are resolved, the House will need to vote again on the bill. Congressman French Hill believes that many of the outstanding issues have already been addressed by the House in its version of the bill, and the Senate should be able to find common ground.
