South Korean Court Overturns Bithumb's Six-Month Suspension

In a significant development, a South Korean court has revoked Bithumb's six-month partial business suspension, as reported by Yonhap News. The decision was made by Judge Gong Hyeon-jin of the Seoul Administrative Court's 2nd Administrative Division, who accepted Bithumb's application for a stay of execution on the same day it was filed. However, it remains unclear whether the $24.6 million fine imposed by the Financial Intelligence Unit (FIU) has also been suspended. The fine and suspension were initially imposed in March, after the FIU alleged that Bithumb had committed numerous violations of local anti-money laundering regulations. Bithumb, one of South Korea's largest cryptocurrency exchanges, had requested the court to lift the suspension and fine, citing that the FIU's claims were unfounded. The sanctions were related to Bithumb's alleged failure to comply with the Act on Reporting and Using Specified Financial Transaction Information, with the FIU claiming that the exchange had committed approximately 6.65 million violations. These violations included failures to verify customer identities and improperly blocking transactions. While the court's ruling is a positive development for Bithumb, it comes amidst reports that the Personal Information Protection Commission has launched an investigation into several cryptocurrency platforms, including Bithumb and Upbit, regarding the sharing of order books with overseas platforms. The case against Bithumb is part of a broader effort by South Korean regulators to increase oversight of the cryptocurrency market. In a similar instance, the FIU had previously imposed a three-month partial suspension and a $35.2 billion won fine on Dunamu, the operator of Upbit, for compliance gaps. Bithumb, established in 2014, is one of the largest cryptocurrency exchanges in South Korea by trading volume, according to CoinGecko data. The lifting of the suspension comes two months after Bithumb accidentally distributed billions of dollars worth of bitcoin to users.
