US Regulator Takes New York to Court Over Prediction Market Dispute

In its latest move to assert nationwide regulatory control, the US Commodity Futures Trading Commission has filed a lawsuit against New York, arguing that the state's efforts to curtail prediction market firms infringe on its federal jurisdiction. This development comes after New York recently took action against major players in the industry, including Coinbase and Gemini, alleging violations of state gambling laws. The CFTC maintains that it has exclusive authority over commodity futures, options, and swaps traded on federally regulated exchanges, thereby preempting state law. However, a coalition of 37 state attorneys general has countered that this stance undermines their ability to protect citizens. The CFTC's chairman has made this initiative a priority, with similar lawsuits filed against other states. In response to the lawsuit, New York officials emphasized their commitment to enforcing state gambling laws and protecting consumers.
