US Regulatory Body Takes New York to Court Over Prediction Market Dispute
In its latest move to assert nationwide regulatory control, the US Commodity Futures Trading Commission has filed a lawsuit against New York. This action aims to protect the agency's authority over prediction market firms, which it believes is being challenged by the state's attempts to curtail their activities under state gaming laws. The CFTC argues that federal law grants it exclusive jurisdiction over commodity futures, options, and swaps traded on federally regulated exchanges, thereby preempting state law. The lawsuit comes after New York targeted several companies, including Coinbase and Gemini, for allegedly violating state gambling laws with their prediction market contracts. The CFTC's stance is supported by its role as a federal derivatives regulator, but 37 state attorneys general have countered that this position threatens their ability to safeguard citizens. The agency's chairman has made this a key initiative, with similar lawsuits filed against other states. The dispute centers on the classification of event contracts as derivatives instruments within federal jurisdiction, with the CFTC arguing that its regulatory authority is being undermined by state lawsuits.
