US Regulatory Body Takes New York to Court Over Prediction Market Oversight

The US Commodity Futures Trading Commission has filed a lawsuit against New York, marking the latest move in its efforts to assert its nationwide regulatory authority over prediction market firms. This action comes after New York took legal action against Coinbase and Gemini, alleging that their prediction market contracts contravened state gambling laws. The CFTC has maintained that it has exclusive jurisdiction over commodity futures, options, and swaps traded on federally regulated exchanges, effectively preempting state law. However, a group of 37 state attorneys general has countered that this stance undermines their ability to protect citizens. The CFTC has also taken similar action against Arizona, Connecticut, and Illinois, claiming that event contracts fall under federal jurisdiction. In response to the lawsuit, New York's Attorney General and Governor stated that they are enforcing state laws on gambling to protect consumers, and will continue to defend their laws in court.
