Time Running Out for Clarity on Crypto Legislation
The cryptocurrency market structure bill has seen little public progress over the past month, making its prognosis difficult. However, it's evident that time is running out for its passage. The crypto market structure bill's progress, or lack thereof, has significant implications. Much of the guidance provided by the Securities and Exchange Commission staff is not permanent and can be altered by future administrations. The market structure legislation aims to solidify crypto industry regulations into law, making them harder to reverse. Without the Clarity Act, the industry may face similar challenges in the future. A critical deadline is approaching, with Memorial Day, May 25, being seen as a 'drop-dead' date for legislation to advance. Lawmakers will soon focus on their campaigns, leaving little time for crypto legislation. Before Congress adjourns, it must address funding for the Department of Homeland Security and the potential appointment of Kevin Warsh as the next Fed chair. The crypto industry is eager to see the bill passed, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, the committee's progress remains unclear, and outstanding issues, including stablecoin yield, need to be resolved. Even after these issues are addressed, the House will need to vote on the bill again. Congressman French Hill believes that many of the outstanding issues have already been resolved by the House in its version of the bill, making it easier for the Senate to find common ground.
