Time's Running Out for Crypto Clarity

The crypto market structure bill has seen minimal public progress over the past month. While predicting the bill's outcome is challenging, it's clear that time is of the essence for its passage. The crypto market is at a critical juncture, and the clock is ticking. The Securities and Exchange Commission has been issuing staff statements, but these are not permanent guidance, and the SEC needs time to develop rules that will undergo a notice-and-comment period. The market structure legislation aimed to solidify crypto industry goals and regulations into law, making it harder for future administrations to undo these rules. Without the Clarity Act, the industry may face the same challenges in the future. Memorial Day, May 25, is seen as a deadline for legislation to advance and have a chance at passage before the election. Lawmakers will soon leave town to focus on their campaigns, leaving little time for crypto legislation. Before Congress departs, it will address a bill to fund the Department of Homeland Security and consider Kevin Warsh's potential appointment as the next Fed chair. The crypto industry is eager for this bill, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it's unclear how close the committee is to moving forward, and outstanding issues, such as stablecoin yield, remain unresolved. Even when these issues are addressed, the House will need to revote on the bill. Congressman French Hill believes that many outstanding issues have been resolved by the House in its version of the bill, and the Senate should be able to find common ground.
