Time's Running Out for Crypto Clarity
The cryptocurrency market structure bill has seen little public progress over the past month. While predicting the bill's fate is challenging, it's clear that time is running out for its passage. The crypto market has been awaiting clarity on regulations, and the current state of uncertainty may persist if the bill doesn't move forward. The Securities and Exchange Commission has been issuing staff statements, but these are not permanent guidance, and the SEC needs time to develop rules that will undergo a notice-and-comment period. The crypto industry is eager for the Clarity Act to become law, as it would cement regulations and make it harder for future administrations to reverse them. Without this bill, the industry may face the same conversations in the future. Memorial Day, May 25, is seen as a critical deadline for legislation to advance, and lawmakers will soon be distracted by their campaigns. Before Congress leaves, they will focus on funding the Department of Homeland Security and potentially confirming the next Fed chair. The crypto industry has expressed its desire for the bill, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it's unclear how close the committee is to moving forward, and outstanding issues, such as stablecoin yield, remain unresolved. Even when these issues are resolved, the House will need to vote again on the bill. Congressman French Hill believes that the Senate can find common ground, given the House's work on the bill.
