US Regulator Takes New York to Court Over Prediction Market Dispute
In its latest move to assert nationwide control over prediction market firms, the US Commodity Futures Trading Commission has filed a lawsuit against New York. This action follows the state's own lawsuit against cryptocurrency exchanges Coinbase and Gemini, alleging their prediction market contracts breached state gambling laws. The CFTC argues that, as the federal derivatives regulator, it has exclusive jurisdiction over commodity futures, options, and swaps traded on federally regulated exchanges, thereby preempting state law. However, 37 state attorneys general have countered this stance, signing a legal brief that claims the regulator's position threatens their ability to protect citizens. The CFTC has also taken similar action against Arizona, Connecticut, and Illinois, with its chairman emphasizing the need to protect Americans' access to event contracts. In response, New York officials stated they are enforcing state laws on gambling to safeguard consumers, vowing to hold accountable any platforms that violate these laws.
