Time's Running Out for Crypto Clarity

As April draws to a close, the crypto market structure bill has seen minimal public progress. While predicting the bill's fate is challenging, it's clear that time is of the essence for its passage. The current state of affairs, including statements from the Securities and Exchange Commission staff, lacks permanence and is subject to change without concrete legislation. The crypto industry is eager for the Clarity Act to cement regulations into law, making it more difficult for future administrations to reverse these rules. Without this bill, the industry may face similar challenges in the future. A crucial deadline is approaching, with Memorial Day (May 25) being seen as a 'drop-dead' date for legislation to advance. Before Congress breaks for the summer, they will need to address a bill to fund the Department of Homeland Security and consider Kevin Warsh's potential appointment as the next Fed chair. The crypto industry is pushing for the bill, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it remains unclear how close the committee is to moving forward, with outstanding issues such as stablecoin yield and sales practices still unresolved. Even when these issues are addressed, the House will need to vote again on the bill. Congressman French Hill believes that many of the outstanding issues have already been resolved by the House in its version of the bill, making it easier for the Senate to find common ground.
