Time's Running Out for Crypto Clarity

The proposed crypto market structure bill has seen little public progress over the past month. While predicting the bill's fate is challenging, it's clear that time is of the essence for its passage. The crypto market has been awaiting clarity on regulations, and the current lack of progress may lead to further uncertainty. The Securities and Exchange Commission has been issuing staff statements, but these are not permanent guidance, and the SEC needs time to establish rules through a notice-and-comment period. The market structure legislation aimed to cement crypto industry goals and regulations into law, making it more difficult for future administrations to reverse these rules. Without the Clarity Act, the industry may face similar conversations in the future. Memorial Day, May 25, is seen as a critical deadline for legislation to advance and have a chance at passage before the election. Lawmakers will soon leave town to focus on their campaigns, leaving little time for crypto legislation. Before Congress departs, it will need to address funding for the Department of Homeland Security and consider Kevin Warsh's potential appointment as the next Fed chair. The crypto industry is eagerly awaiting the passage of this bill, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it remains unclear how close the committee is to moving forward, with outstanding issues such as stablecoin yield and decentralized finance still unresolved. Even when these issues are resolved, the House will need to vote again on the bill. Congressman French Hill believes that many of the outstanding issues have already been addressed by the House in its version of the bill, and the Senate should be able to find common ground.
