Time is Running Out for Clarity on Crypto Legislation

The narrative surrounding the bill's potential passage this month is bleak, and it's unlikely that it will happen. The Securities and Exchange Commission has made statements on market structure issues, but these are not permanent and can be changed by future administrations. The crypto industry is pushing for the Clarity Act to cement regulations into law, making it more difficult for future administrations to undo them. Without this bill, the industry may face the same challenges in the future. Memorial Day, May 25, is seen as a critical deadline for legislation to advance if it is to have a chance at passage before the election. Before Congress leaves for the summer, they will need to address other pressing matters, such as funding for the Department of Homeland Security and the potential appointment of a new Fed chair. The crypto industry is eager for the bill's passage, with over 100 companies signing an open letter urging a markup hearing in the Senate Banking Committee. However, it's unclear how close the committee is to moving forward, and several outstanding issues need to be resolved. Even when these issues are addressed, the House will need to vote on the bill again. Congressman French Hill believes that many of the outstanding issues have already been resolved by the House in its version of the bill, and the Senate should be able to find common ground.
