US Regulator CFTC Takes New York to Court Over Prediction Market Dispute
In its latest move to assert nationwide authority, the US Commodity Futures Trading Commission has filed a lawsuit against New York, seeking to prevent the state from interfering with prediction market firms. This development comes after New York took legal action against Coinbase and Gemini, alleging that their prediction market contracts breached state gambling laws. The CFTC maintains that federal law grants it exclusive jurisdiction over commodity futures, options, and swaps, thereby preempting state law. However, a coalition of 37 state attorneys general has countered that this stance undermines their ability to protect citizens. The CFTC has also sued other states, including Arizona, Connecticut, and Illinois, over similar issues. The regulator's chairman has made it a priority to safeguard the agency's regulatory authority over prediction markets, while New York officials argue that they are enforcing state laws to protect consumers from gambling violations.
