US Regulator Clashes with New York Over Prediction Market Oversight
In a recent lawsuit, the US Commodity Futures Trading Commission asserted its nationwide regulatory dominance over prediction market firms, suing New York for attempting to intervene. This move follows New York's own lawsuits against Coinbase, Gemini, and Kalshi, alleging violations of state gambling laws. The CFTC argues that federal law grants it exclusive jurisdiction over commodity futures, options, and swaps, thereby preempting state law. However, 37 state attorneys general have countered that this stance undermines their ability to protect citizens. The CFTC's chairman has made this initiative a priority, also suing Arizona, Connecticut, and Illinois over similar issues. In response to the lawsuit, New York officials stated that they are upholding state laws on gambling to safeguard consumers, whether in prediction markets or casinos, and will hold accountable any platforms violating these laws.
