The US Securities and Exchange Commission has announced that software facilitating cryptocurrency transactions through individual wallets will not be subject to registration and regulation as a brokerage firm. This latest guidance from the agency is part of an ongoing effort to provide clarity on cryptocurrency regulations in the absence of permanent rules.
The SEC has outlined specific conditions under which such software will not be considered a brokerage service, including not soliciting investors for specific transactions and not providing commentary on potential execution routes. However, if the software offers financing, investment recommendations, or handles user assets, it will fall under the agency's regulatory purview. The SEC is working on developing comprehensive rules for cryptocurrency activities, with Chairman Paul Atkins indicating that proposals are nearing completion. These interim guidelines aim to provide clarity and certainty for the industry while more permanent regulations are being developed.
