The US Securities and Exchange Commission has announced that software enabling users to conduct cryptocurrency securities transactions through their personal wallets will not require registration or regulation as a brokerage firm. This clarification is part of the agency's ongoing efforts to provide guidance to the cryptocurrency industry in the absence of formal regulations. The SEC has provided a set of guidelines for developers to ensure their software does not fall under brokerage regulations, including not soliciting investors or providing commentary on potential transactions.
However, if the software offers financing, investment recommendations, or handles user assets, it will be subject to regulatory oversight. The agency is working on developing formal rules for cryptocurrency regulations, with SEC Chairman Paul Atkins stating that comprehensive rules are nearing the proposal stage. In the meantime, the agency is providing interim guidance to provide clarity and certainty for the industry.
