Commodity Futures Trading Commission Chairman Mike Selig emphasized that the agency will continue to assert its exclusive regulatory authority over prediction markets in court, stating that any validly offered product within a CFTC-regulated exchange falls under its jurisdiction, regardless of the subject matter. This stance is being tested in lawsuits against several states, including Arizona, Illinois, and Connecticut, with the CFTC arguing that federal regulation supersedes state laws when it comes to commodity derivatives markets.

A recent Third Circuit Court ruling has bolstered the agency's position, and under Selig's leadership, the CFTC is pursuing a significant litigation effort to establish that prediction markets offer derivatives products under the Commodity Exchange Act, rather than gambling services regulated by individual states.
