The Crypto Clarity Act, aimed at establishing clear regulations for the US crypto market, faces significant hurdles despite signs of progress, according to Wintermute's head of policy, Ron Hammond. Hammond estimates the bill has a 30% chance of passing this year, citing political friction, stalled negotiations, and shifting timelines. The act seeks to codify how the Securities and Exchange Commission and Commodity Futures Trading Commission oversee digital assets in the US.

Hammond's outlook is cautious, noting that the legislative process is advancing unevenly. The bill's passage is seen as crucial for institutional adoption of crypto, as it would provide clear rules on which digital assets are securities versus commodities and define how they can be traded and regulated.

However, traditional financial institutions, particularly banks, remain a significant obstacle due to disagreements over stablecoins offering yield. Despite these challenges, Hammond believes the bill still has a viable path forward, with progress in committee and continued negotiations potentially keeping it alive into midyear.
