Commodity Futures Trading Commission Chairman Mike Selig emphasized that the agency will persist in defending its exclusive regulatory authority over prediction markets in court. Selig stated, 'Regardless of the subject matter, whether it's sports, politics, or otherwise, if the product is validly offered within a CFTC-regulated exchange, it falls under our jurisdiction.' The CFTC is currently engaged in lawsuits against several states, including Arizona, Illinois, and Connecticut, to assert its regulatory authority over commodity derivatives markets.
A recent Third Circuit Court ruling has bolstered the CFTC's position, affirming its oversight of prediction markets. Selig clarified that the agency's primary concern is ensuring that states do not overstep their boundaries by imposing gambling laws on derivatives products that are subject to federal regulation. The CFTC is also in the process of formal rulemaking to clarify its regulatory framework for prediction markets and is open to feedback from stakeholders.
