In a recent statement to CoinDesk, Commodity Futures Trading Commission (CFTC) Chairman Mike Selig underscored the agency's commitment to defending its 'exclusive regulatory authority' over prediction markets. Selig highlighted that any product offered within a CFTC-regulated exchange falls under the agency's jurisdiction, regardless of the subject matter.
The CFTC's lawsuits against various states, including Arizona, Illinois, and Connecticut, aim to establish the agency's authority over commodity derivatives markets. The agency's stance is bolstered by a recent Third Circuit Court ruling, which affirmed the CFTC's oversight of prediction markets.
Selig emphasized that the Commodity Exchange Act clearly outlines federal regulation for swaps on federally regulated Designated Contract Markets, superseding state laws. The CFTC is also engaged in a formal rulemaking process to clarify its prediction market oversight, considering public input and evaluating the public interest. Additionally, the agency is reviewing comments on its joint interpretation with the Securities and Exchange Commission (SEC), aiming to establish clear guidelines for digital assets and avoid regulatory conflicts.
