The Commodity Futures Trading Commission (CFTC) will continue to assert its 'exclusive regulatory authority' over prediction markets in court, as stated by Chairman Mike Selig in an interview with CoinDesk. Selig emphasized that the CFTC's regulatory oversight applies to all prediction markets, regardless of the subject, as long as they are offered within a CFTC-regulated exchange.
The CFTC's lawsuits against several states aim to establish the agency's sole authority over commodity derivatives markets. A recent Third Circuit Court ruling supporting the CFTC's oversight of prediction markets has reinforced the agency's position. The CFTC is engaged in a significant litigation effort to establish that prediction markets provide derivatives products under the Commodity Exchange Act, rather than being subject to state gambling laws. Selig noted that the agency's regulatory authority is clear and that states cannot override federal oversight.
The CFTC is also involved in a consolidated case before the Ninth Circuit Court of Appeals and has filed an amicus brief. The agency is currently undergoing a formal rulemaking process to clarify its oversight of prediction markets and is open to suggestions.
Additionally, the CFTC and the Securities and Exchange Commission (SEC) have published interpretative guidance on the regulatory framework for digital assets, which provides a clear taxonomy for distinguishing between commodities and securities.
