Chairman of the Commodity Futures Trading Commission, Mike Selig, has stated that the agency will continue to assert its exclusive regulatory authority over prediction markets in court. According to Selig, the agency's regulatory purview encompasses any valid product offered within a CFTC-regulated exchange, regardless of the subject matter. This stance is reflected in the agency's ongoing lawsuits against several states, including Arizona, Illinois, and Connecticut, which aim to establish the CFTC's authority in commodity derivatives markets.
The recent Third Circuit Court ruling has bolstered the CFTC's position, and Selig emphasizes that federal regulation takes precedence over state laws in these matters. The agency is also engaged in a formal rulemaking process to clarify its oversight of prediction markets and is open to suggestions and feedback from stakeholders.
