The head of policy at Wintermute, a leading crypto market maker, has expressed cautious optimism about the prospects of the Crypto Clarity Act, estimating its chances of passage this year at around 30%. This assessment comes as the legislative process advances, albeit unevenly, with the aim of establishing clear rules for crypto market structure regulation in the US. Hammond's prediction is broadly in line with other market signals, including a recent Punchbowl survey and the prediction market Kalshi. Despite the uncertainty surrounding the bill's trajectory, Hammond sees incremental progress, with lawmakers pushing for a committee vote as early as April 20.

However, he cautions that timelines have been fluid for months. The passage of the Clarity Act is widely regarded as a crucial factor in unlocking institutional adoption of crypto, as it would provide clear guidelines on which digital assets are securities versus commodities and how they can be traded and regulated. The current fragmented framework has kept many large asset managers, banks, and pension funds on the sidelines due to legal and compliance risks.

A comprehensive market structure law would reduce ambiguity, giving institutions the confidence to increase their exposure to crypto. Nevertheless, significant hurdles remain, particularly from traditional financial institutions, which are resisting attempts to find a solution on the issue of stablecoin yields. The dispute has already derailed at least one compromise, and expectations for a new version are tempered.

The politics surrounding the bill are also complex, with Democrats facing a difficult balancing act due to crypto industry funding and unresolved concerns around DeFi and anti-money laundering compliance. Additional political headwinds may emerge in the coming months, potentially complicating Democratic support. Despite these challenges, Hammond believes the bill still has a viable path forward, with progress in committee and continued negotiations potentially keeping it alive into mid-year. Wintermute, one of the largest crypto market makers globally, has a significant stake in the outcome, having expanded its US footprint and grown its New York team.

The firm's commitment to the US market reflects a broader industry commitment to the region, particularly under a more favorable regulatory environment. The outcome of the Clarity Act is consequential, and while Hammond sees 'light at the end of the tunnel,' he emphasizes that passage in 2026 will require breakthroughs that have so far proved elusive.
