In a statement to CoinDesk, Commodity Futures Trading Commission Chairman Mike Selig emphasized the agency's commitment to defending its exclusive regulatory authority over prediction markets in court. Selig clarified that the CFTC's regulatory oversight applies to any valid product offered within a CFTC-regulated exchange, regardless of the subject matter.

The agency is currently engaged in lawsuits against several states, including Arizona, Illinois, and Connecticut, to establish its authority over commodity derivatives markets. This effort is part of a broader litigation campaign to assert that prediction markets offer derivatives products under the Commodity Exchange Act, rather than gambling services regulated by individual states. Selig pointed out that a recent Third Circuit Court ruling supporting the CFTC's oversight of prediction markets reinforces the agency's position.

He also noted that the CFTC is open to suggestions during its formal rulemaking process to clarify its regulatory framework for prediction markets.
