The US Securities and Exchange Commission has announced that software providing user interfaces for cryptocurrency transactions using individual wallets will not be required to register and comply with broker regulations. This clarification is part of the agency's ongoing efforts to provide guidance to the cryptocurrency industry in the absence of formal rules.
The SEC has outlined a set of criteria that software developers can follow to avoid being classified as broker-dealers, including not soliciting investors or providing commentary on potential transaction routes. However, if the software offers financing, investment recommendations, or handles user assets, it will be subject to regulatory oversight. The agency is working on developing formal rules for the cryptocurrency industry, with SEC Chairman Paul Atkins indicating that comprehensive rules are nearing the proposal stage.
In the meantime, the SEC will continue to issue interim guidance to provide clarity and certainty for the industry.
