In an interview with CoinDesk, Commodity Futures Trading Commission (CFTC) Chairman Mike Selig emphasized that the agency will persist in defending its 'exclusive regulatory authority' over prediction markets in court. Selig stated, 'Regardless of the subject, whether it's sports, politics, or anything else, if it's a valid product offered within a CFTC-regulated exchange, we have the authority to regulate it.' The CFTC is currently engaged in lawsuits against several states, including Arizona, Illinois, and Connecticut, to establish its jurisdiction over prediction markets. Selig's comments come after a recent Third Circuit Court ruling that supported the CFTC's oversight of these markets. The agency believes that the Commodity Exchange Act clearly grants it regulatory authority over commodity derivatives markets, including prediction markets.

Selig noted that the CFTC's primary concern is ensuring that these markets operate under federal regulation, rather than being subject to state gambling laws. He also mentioned that the agency is open to feedback and suggestions as it navigates the formal rulemaking process to clarify its oversight of prediction markets.
