NASHVILLE, Tenn. — The Securities and Exchange Commission is on the verge of introducing a comprehensive 'regulation crypto' to outline its approach to overseeing the cryptocurrency industry, distinguishing between transactions that may be classified as securities and those that are not, as stated by SEC Chair Paul Atkins on Monday. The proposed 'reg crypto' is currently under review by the White House Office of Information and Regulatory Affairs, indicating it is one step away from publication. This rulemaking focuses on the Securities Act of 1933 and will address fundraising and startup exemptions, among other key issues, according to Atkins' statement at an event co-hosted by Vanderbilt University and the Blockchain Association.

Following his question-and-answer session, Atkins informed CoinDesk that the SEC also plans to release its long-awaited innovation exemption soon. "We welcome feedback and reactions," he stated. "Although it's not a formal rule, we need to assess its functionality and identify any potential issues." A crucial aspect of this exemption, according to Atkins, is that it will not unfairly disadvantage established companies and will focus on supporting startups.

"We want to encourage experimentation within this framework," he explained. Atkins emphasized Congress's role at multiple points during his talk, stating that the SEC's rulemaking process is well underway, regardless of Congressional actions.

"I believe we have sufficient time to move forward, despite the upcoming midterms — although I would prefer a cooperative Congress — they can create obstacles, but they won't significantly slow us down," he said. Atkins also urged the audience to participate in the upcoming election, citing Senator Bernie Moreno as an example. "If Congress drastically changes course, it will not benefit anyone and will create more uncertainty, leading people to wonder if this is just a passing phase," he said. "We must ensure that our supporters are in Congress.

The previous election demonstrated the benefits of having strong representation."
