The US Securities and Exchange Commission (SEC) has announced that software enabling cryptocurrency wallet transactions will not be required to register as a broker, providing clarity for the crypto industry. This stance is part of the agency's ongoing efforts to provide guidance on cryptocurrency regulations. The SEC staff has outlined a set of criteria for software developers to follow in order to avoid being classified as a broker-dealer, including not soliciting investors or providing investment commentary.

However, if the software offers financing, investment advice, or handles user assets, it will be subject to regulatory oversight. The SEC is working on developing comprehensive rules for cryptocurrency regulations, with Chairman Paul Atkins indicating that proposals are nearing completion. In the interim, the agency is providing guidance through staff statements to help the industry move forward.
