The Commodity Futures Trading Commission will continue to assert its 'exclusive regulatory authority' over prediction markets, according to Chairman Mike Selig. In an interview with CoinDesk, Selig emphasized that the agency's jurisdiction applies regardless of the subject matter, be it sports or politics, as long as the product is offered within a CFTC-regulated exchange. The CFTC is currently engaged in lawsuits against several states, including Arizona, Illinois, and Connecticut, to establish its authority over commodity derivatives markets.
Selig cited a recent Third Circuit Court ruling in support of the CFTC's position. The agency is also undergoing a formal rulemaking process to clarify its oversight of prediction markets and is open to suggestions on the process. Additionally, the CFTC and SEC have published interpretative guidance on the taxonomy of digital assets, aiming to provide clear lines of authority between the two agencies.
