Japan's government has greenlit a legislative amendment aimed at categorizing cryptocurrencies as financial products, signaling a significant regulatory shift. By bringing crypto assets under the Financial Instruments and Exchange Act, the same framework governing stocks and securities, Japan is poised to bolster oversight of the sector. This development marks a departure from the current approach, which primarily views cryptocurrency as a payment method under the Payment Services Act, focusing on aspects like custody and anti-money laundering.

The proposed rules would outlaw insider trading, necessitate annual disclosures from issuers, and substantially increase penalties for non-compliance, including longer prison sentences and heavier fines. Authorities, such as the Securities and Exchange Surveillance Commission, would also see their regulatory powers expanded, ensuring greater market transparency and investor protection, according to Minister for Financial Services Satsuki Katayama, who highlighted the importance of adapting to evolving financial landscapes while ensuring market integrity.
