The Securities and Exchange Commission is on the verge of unveiling a comprehensive cryptocurrency regulation, which will provide clear guidelines on the distinction between transactions that constitute securities and those that do not. As announced by SEC Chair Paul Atkins, the proposed regulation is currently under review by the White House Office of Information and Regulatory Affairs. This forthcoming rulemaking will focus on the Securities Act of 1933, addressing issues such as fundraising and startup exemptions.
Additionally, the SEC plans to introduce an innovation exemption, which aims to foster experimentation and growth in the industry without unfairly disadvantageing established players. Atkins emphasized the importance of public input and engagement in the regulatory process, particularly in the lead-up to the upcoming election, where congressional support will be crucial in shaping the future of the crypto industry.
