The Securities and Exchange Commission is nearing the release of a proposed 'regulation crypto' that will outline its approach to overseeing the crypto industry, including distinguishing between transactions that may be considered securities and those that are not, as announced by SEC Chair Paul Atkins on Monday. The proposed regulation is currently under review by the White House Office of Information and Regulatory Affairs, marking the final step before its publication. This rulemaking will focus on the Securities Act of 1933, addressing issues such as fundraising and startup exemptions.
Following his speech at an event hosted by Vanderbilt University and the Blockchain Association, Atkins mentioned that the SEC also plans to introduce its long-awaited innovation exemption soon, seeking feedback on its functionality and potential issues. A key aspect of this exemption is that it aims to create a level playing field, avoiding disadvantage to existing companies while promoting experimentation among startups.
Atkins emphasized the importance of congressional support, noting that the SEC's rulemaking process is underway despite potential congressional actions. He encouraged the audience to participate in the upcoming election, citing the example of Senator Bernie Moreno, to ensure that Congress remains supportive of the crypto industry's development.
