Commodity Futures Trading Commission Chairman Mike Selig reaffirmed the agency's commitment to defending its exclusive regulatory authority over prediction markets in court. According to Selig, the agency's jurisdiction applies to any validly offered product within a CFTC-regulated exchange, regardless of the subject matter. The CFTC has been actively pursuing lawsuits against several states, including Arizona, Illinois, and Connecticut, to establish its authority over commodity derivatives markets. A recent Third Circuit Court ruling has bolstered the agency's position, supporting its argument that prediction markets fall under federal regulation rather than state gambling laws.

The CFTC is also engaged in a formal rulemaking process to clarify its oversight of prediction markets and is considering public feedback on its interpretative guidance.
